1. Acceptance of Terms

By accessing and using the OTASPHE website (“Site”), placing an order, or purchasing any product (including women’s tops, dresses, and other apparel), you (“Customer”, “User”) agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or make any purchase.

We reserve the right to update, change, or replace any part of these Terms at any time. Continued use constitutes acceptance of the updated Terms.

2. Eligibility

By using our Site, you represent that:

You have the legal authority to enter into a binding contract.
You will not use our products for any illegal or unauthorized purpose.

OTASPHE sells women’s apparel (including but not limited to tops, blouses, t-shirts, sweaters, dresses, maxi dresses, mini dresses, and formal gowns).

Material Disclosure: Our garments are made from standard materials such as cotton, polyester, spandex, and fabric blends. Claims such as “soft,” “breathable,” and “durable” are based on general fabric characteristics. We do not represent our products as medical devices or capable of providing any health benefit.
Color & Image Accuracy: We attempt to display products as accurately as possible. However, due to screen variations, actual colors may differ slightly from images.
Availability: All products are subject to availability. We reserve the right to discontinue any product at any time.

4. Orders and Acceptance

Order Confirmation: When you place an order, we will send you a confirmation email. This does not constitute acceptance of your order.
Acceptance: We accept your order only when we ship the product. We reserve the right to refuse or cancel any order for reasons including but not limited to: pricing errors, stock unavailability, fraud detection, or payment processing failure.
Order Modifications: Once an order is placed, you cannot modify or cancel it without contacting our customer service team. Please contact us immediately at contact@otasphe.com.

5. Pricing and Payment

Taxes & Duties: You are responsible for any applicable sales tax, VAT, customs duties, or import fees for your country.
Payment Methods: We accept payment via credit card, debit card, PayPal, and other available methods. All payment information is processed securely through third-party payment gateways. We do not store your full payment card details.
Fraud Prevention: We reserve the right to perform fraud checks and withhold any order that appears suspicious.

6. Shipping and Delivery

Delivery times are estimates and not guaranteed.
Risk of loss and title for purchased items pass to you upon delivery to the carrier.
You must inspect your package upon delivery. Report any damaged or missing items within 48 hours to contact@otasphe.com.

7. Returns and Refunds

Our return policy is detailed in our Return & Refund Policy. In summary:

Standard Returns: Accepted within [e.g., 14 days] of delivery for unworn, unused items with original packaging.
Return Shipping: Customer is responsible for return shipping costs unless the item is defective.
Refunds: Processed to the original payment method within [e.g., 7-10] business days after receiving the returned item.
Exclusions: Custom-made items and items marked "Final Sale" are non-returnable.

8. Intellectual Property

These Terms shall be governed by the laws of Indonesia, without regard to its conflict of law principles.

Dispute Resolution:

Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration in Jakarta, Indonesia, under the rules of the Indonesian Arbitration Center (BANI).
Class Action Waiver: You agree to bring any claim on an individual basis and waive the right to participate in a class action lawsuit.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and Shipping/Return Policies, constitute the entire agreement between you and OTASPHE regarding the use of our Site and purchase of our products, superseding any prior agreements or communications.
